BILLING POLICIES
Haimo Law generally bills on a fixed costs basis. However, some forms of representation are more appropriate to be billed hourly or some combination of both hourly and fixed costs. As you will see below, probate lends itself to a deferred compensation structure.

Fixed Fees:
- Estate Planning
- Business Planning

- *Probate (Estate Administration)
Fixed fees include the initial consultation, a subsequent meeting via video conference, preparation of the documents, execution ceremony for the documents, attorney time, travel, expenses and other fees. We do reserve the right to track and bill for time if unforeseeable events arise or if the process becomes unreasonably longer for reasons outside of our control.
*Probate can sometimes be billed as a fixed fee under certain circumstances.
Hourly Fees:
- Ongoing estate or business representation with a reasonable retainer. Retainer is typically kept in trust and applied towards the final bill and the you are billed monthly for services rendered.
- *Probate (Estate Administration) – hourly fee for ordinary services; increased fee for extraordinary services, such as contests, creditors claims, and real estate matters.
- Small claims litigation.
*Probate administration can be billed hourly with a retainer. Alternatively, the firm may agree to deferred compensation by agreeing to receive a small percentage of the estate, often 3%. In some cases, the firm will agree to some combination of hourly and small percentage of the estate. This arrangement often depends on the client’s needs, goals and circumstances. However, please note, that filing fees and costs will not be advanced by the firm.
